1. ACCEPTANCE

These Terms of Service (the ‘Terms’) govern your use of the Think Equal Learning Management System (the ‘LMS’). By creating an account, or by clicking ‘I Accept’ when prompted, you agree to be bound by these Terms and by our LMS Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, please do not create an account or otherwise use the LMS.

2. DEFINITIONS

• ‘Think Equal’, ‘we’, ‘us’ means the Think Equal entity responsible for the LMS, as set out in the Privacy Policy.
• ‘Partner’ means the school, ministry of education, or other organisation through which your access to the LMS is arranged.
• ‘User’, ‘you’ means anyone who registers for or uses the LMS.
• ‘Content’ means training materials, courses, and other material made available through the LMS.
• ‘Your Content’ means anything you submit, including evidence of completed training activities.

3. THE SERVICE

The LMS is Think Equal’s online training platform. We use it to deliver teacher training courses, track your progress, let you submit evidence of completed activities, and issue certificates confirming completion.

4. ELIGIBILITY AND ACCESS

The LMS is intended for adult professionals, teachers, trainers, and school or ministry staff, not for use by children.

Access is normally arranged through a Partner. Your continued access may depend on your relationship with that Partner; if that relationship ends, your access may be suspended or ended even while these Terms remain in effect.

5. YOUR ACCOUNT AND RESPONSIBILITIES

• Provide accurate information when registering.
• Keep your login credentials confidential and do not share your account with anyone else.
• Tell us promptly if you believe your account has been accessed without your permission.
• You are responsible for activity that takes place under your account.

6. ACCEPTABLE USE

You agree not to:

• Share your login with another person, or access an account that is not yours.
• Upload unlawful, harmful, or infringing material.
• Upload any identifiable image or personal data of a child, consistent with our Privacy Policy.
• Attempt to disrupt, reverse-engineer, or gain unauthorised access to the LMS.
• Misrepresent your completion of training, or misuse a certificate issued through the LMS.

7. CONTENT YOU SUBMIT

You retain ownership of Your Content. By submitting it, you grant Think Equal a licence to use it to verify and record your training completion, and for the reporting purposes described in our Privacy Policy. You confirm that you have the right to submit it, and that it does not include identifiable images or personal data of children.

8. CERTIFICATES

A certificate issued through the LMS confirms that our records show you completed the relevant training activities. Unless expressly stated otherwise, it is not a professional qualification or formal accreditation, and Think Equal makes no representation beyond confirming completion in our own records.

9. INTELLECTUAL PROPERTY

All Content and the LMS itself remain the property of Think Equal or our licensors. You may use Content for your own training only, and not for commercial purposes or redistribution, unless we agree otherwise in writing.

10. YOUR RELATIONSHIP WITH YOUR PARTNER ORGANISATION

Where your access is arranged through a Partner, that Partner may set additional rules for your participation in a programme. These Terms govern your use of the LMS itself; any separate arrangement between you and your Partner is between you and them, and Think Equal is not responsible for it.

11. SUSPENSION AND TERMINATION

We may suspend or end your access if you breach these Terms, misuse the LMS, or if required to do so by your Partner or by law. You may stop using the LMS at any time. On ending your access, your data is handled in line with the retention terms in our Privacy Policy.

12. DISCLAIMER

The LMS is provided on an ‘as is’ basis. We do our best to keep it available and accurate but do not guarantee uninterrupted access or that it will always be free of errors.

13. LIMITATION OF LIABILITY

To the extent permitted by law, Think Equal is not liable for indirect or consequential loss arising from your use of the LMS, or from your misuse of the platform or breach of these Terms. Nothing in these Terms limits any liability that cannot lawfully be limited.

14. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes in the LMS or in the law. Where changes are significant, we will take reasonable steps to notify users before they take effect.

15. GOVERNING LAW

These Terms are governed by the laws of the United States, without prejudice to any mandatory local protections that may apply to you regardless of this clause.
